SPONSOR: This “Study Island 2020 Spring Social Media Challenge” (“Contest”) is sponsored by Edmentum, Inc. (“Sponsor”), 5600 W 83rd Street, Suite 300, 8200 Tower, Bloomington, Minnesota 55437, who is solely responsible for all aspects of this Contest.
Participation in the Contest constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding, in all respects. All submissions must be original and must therefore contain no third party material. Entries must be submitted by March 28, 2020 at 11:59 p.m. CT.
TIME PERIOD: The contest will begin Friday, January 17, 2020 at 12:00 a.m. Central Time (CT) and end at 11:59 p.m. CT on March 28, 2020. (the "Contest Period.")
ELIGIBILITY: The Contest is open to all current Sponsor customer employees as of March 28, 2020. Employees, agents, officers and directors of Sponsor, or Sponsor’s affiliates ("Released Parties"), as well as the immediate family members (parents, children, siblings, spouses) or persons living in the same household (whether related or not) of the Released Parties are not eligible to participate in the Contest. All federal, state and local laws and regulations apply. The contest is subject to all applicable laws and void where prohibited, taxed or restricted by law.
WINNER SELECTION: Entries will be judged and three winning entries will be selected by Sponsor.
PRIZES: The two winning entries will each receive a $100 Amazon or Target gift card. Each winner will have three days after their winner notification to choose which gift card type they will receive and if they fail to inform Sponsor of their gift card choice within such three days, the Sponsor will make the choice.
WINNER NOTIFICATION: Sponsor will attempt to contact all prize winners on or before April 10, 2020 by either direct message on one or more of the social media platforms through which the Entrant made their submission or by phone and/or email. Sponsor will make THREE (3) attempts to contact the potential winners. If a prize winner cannot be contacted within 3 days of the first attempted contact, or if a prize winner does not meet the eligibility requirements, that prize winner may be deemed ineligible and an alternate prize winner will be selected by the Sponsor judge(s). Prize winners are required to ensure that their acceptance of the prize does not violate any terms and conditions of their employment or applicable law or preclude or restrict Sponsor from doing business with their employer. To the extent that any tax applies to prize, the prize recipient agrees to be responsible for the payment of such tax.
PUBLICITY: By entering the Contest, each entrant grants Sponsor permission to use the person’s name, likeness, voice, photographs, video, opinions, statements, address
TERMS AND CONDITIONS: The Entrant is responsible for all costs associated with the compilation and submission of entries. All Contest entries must be received during the Contest Period. Incomplete entries will be voided. By participating in this Contest, Entrant and his or her employer agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest.
LIMITATION OF LIABILITY RELEASE: By participating in this Contest, each entrant agrees that Sponsor and related organizations, their agents and employees (“Released Parties”) have no liability whatsoever for any injuries, losses, or damages of any kind which result from
Sponsor reserves the right, without prior notice and at any time, to terminate or suspend the Contest in whole or in part, to extend the End Date or to modify the Contest or these Official Rules in any way, in its sole discretion. Sponsor reserves the right to void any entry if it believes such entry was submitted other than as required by these Official Rules or that the entry has been tampered with in any manner. Sponsor does not assume any responsibility for any schedule changes in the Contest timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Contest schedule.
INTERNET LIMITATIONS of LIABILITY: If for any reason, this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right, at its sole discretion, to terminate, modify or suspend the Contest in whole or in part, at any time, without notice and to select a winner, in Sponsor's sole discretion, from all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to Entrant's systems occasioned by participating in this Contest or by downloading any information necessary to participate in the Contest.
DISPUTES: By entering the Contest, Entrant agrees that (1) Any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and Entrant shall not seek or be entitled to any punitive, consequential, exemplary or other damages, including costs associated with entering the Contest or attorneys' fees. Questions concerning the construction or interpretation of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Contest, shall be determined by the Sponsor in its sole and absolute discretion.
ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS CONTEST AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN MINNESOTA HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
