Spring Questions Contest

SPONSOR: This “Study Island Spring 2020 Questions Contest” (“Contest”) is sponsored by Edmentum, Inc. (“Sponsor”), 5600 W 83rd Street, Suite 300, 8200 Tower, Bloomington, Minnesota 55437, who is solely responsible for all aspects of this Contest.

HOW TO ENTER THE CONTEST: Eligible participants (each, an “Entrant”) can enter by submitting a completed online entry form available at https://info.edmentum.com/2020-SI-Spring-Questions-Contest.html. Only one entry per school building will be accepted. Participation in the Contest constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects. All submissions and supplemental resources must be original and must, therefore, contain no third-party material. Entries for participants must be submitted by March 28, 2020, at 11:59 PM Central Time (CT) for participation.

TIME PERIOD: The contest will begin at 12:00 AM CT on February 9, 2020, and end at 11:59 PM CT on March 28, 2020. This constitutes the "Contest Period."

ELIGIBILITY : The Contest is open to all current Study Island school and district customers of Sponsor in the United States that operate Kindergarten – 12th Grade schools as of March 28, 2020, for participation. The employees, agents, officers and directors of Sponsor, or Sponsor’s affiliates or subsidiaries (the "Released Parties"), as well as the immediate family members (parents, children, siblings, spouses) or persons living in the same household (whether related or not) of the Released Parties are not eligible to participate in the Contest. All federal, state and local laws and regulations apply. This Contest is subject to all application laws and void where prohibited or restricted by law.

WINNER SELECTION: One top elementary, middle, and high school winner (total of three school winners) will be named at the close of the contest period. School winners will be determined by taking the total number of questions answered correctly by all students within the specified contest month divided by the number of active student users in the Study Island program during the specified contest period.

Additionally, the two top performing individual student winners at the elementary, middle, and high school levels (total of six student winners) with the highest total number of Study Island questions answered correctly will be named at the close of the contest period.

PRIZES: The three winning schools (one designated at each of the following levels: elementary, middle, and high) will receive one contest trophy, $250 pizza party for their school, and $250 gift card for school supplies each. The three first place winning students (one designated at each of the following levels: elementary, middle, and high) will receive one contest medal and a $100 Target gift card each. The three second place winning students (one designated at each of the following levels: elementary, middle, and high) will receive one contest medal and a $50 Target gift card each. The prizes must be claimed by May 31, 2020, or prizes will be forfeited, and no compensation will be awarded. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize with another prize of equal or greater value.

WINNER NOTIFICATION: Sponsor will attempt to contact all prize winners on or before April 10, 2020, by phone and/or email. Sponsor will make THREE (3) attempts to contact the potential winners at the telephone or cell phone number and/or email provided when entering the Contest. If a prize winner cannot be contacted within 3 days of the first attempted contact, or if a prize winner does not meet the eligibility requirements, that prize winner may be deemed ineligible and an alternate prize winner will be selected by the judge(s) based on the criteria described herein. In the event of a dispute regarding the identity of an individual who actually submitted a Contest entry, the entry will be deemed submitted by the authorized account holder of the email account. "Authorized account holder" is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitting email address. Prizes are not exchangeable or transferable. Prize winners are required to ensure that their acceptance of the prize does not violate any terms and conditions of their employment or applicable law or preclude or restrict Sponsor from doing business with their employer. To the extent that any tax applies to prize, the prize recipient agrees to be responsible for the payment of such tax.

PUBLICITY: By entering the Contest, each Entrant grants Sponsor permission to use the person’s name, likeness, voice, photographs, video, opinions and statements for advertising, marketing and promotional purposes and also in connection with Sponsor’s distribution of its products and services and each Entrant, on their own behalf and on behalf of their employer, represents and warrants to Sponsor that Entrant’s submission will not include the personally identifiable information of any individual and that the Entrant and/or his or her employer has obtained all appropriate and/or legally required written permissions and consents from any and all individuals (and their parent and/or guardians, as applicable) included in any portion of the submission to enable Sponsor to use such individuals name, likeness, voice, photographs, video, opinions and statements for advertising, marketing and promotional purposes and also in connection with Sponsor’s distribution of its products and services. Entrant shall promptly provide Sponsor with copies of the permissions and consents identified in the prior sentence upon Sponsor’s request. Any use of the forgoing by Sponsor may be in any manner or media now or hereafter known or existing, worldwide, in perpetuity and without compensation to anyone, notice or further consent, unless prohibited by applicable law. The rights granted Sponsor in this paragraph shall include Sponsors right and permission to revise or modify the voice, photographs, videos or statements submitted by Entrant as Sponsor deems appropriate prior to Sponsors use of such as permitted in this paragraph. Entrant and/or his or her employer shall indemnify and hold Sponsor and the Release Parties harmless from and against any costs or damages to such for Entrant and/or his or her employer’s failure to satisfy their obligations under this paragraph.

TERMS AND CONDITIONS: The Entrant is responsible for all costs associated with the compilation and submission of entries. All Contest entries must be received during the Contest Period specified above. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Entries must be submitted in English. By participating in this Contest, Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest.

LIMITATION OF LIABILITY RELEASE:By participating in this Contest, each entrant agrees that Sponsor and related organizations, their agents and employees (“Released Parties”) have no liability whatsoever for any injuries, losses, or damages of any kind which result from use of the Prize, or by participation in the Contest. No responsibility is assumed by Sponsor for (a) incorrect or inaccurate entry information or late, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries received through impermissible channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Contest including, without limitation, multiple entries by the same person through use of automatic registration or other similar programs; (e) typographical, electronic or human errors that may occur in the offer or administration of the Contest or the processing of entries; (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest, or from viewing, playing or downloading any material from Sponsor’s website; or (g) from the acceptance or use of the Prize.

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS CONTEST AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN MINNESOTA HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
