Official Rules

SPONSOR: This contest is sponsored by Edmentum, Inc. (“Sponsor”), 5600 W 83rd Street, Suite 300, 8200 Tower, Bloomington, Minnesota 55437, who is solely responsible for all aspects of this Contest.

HOW TO ENTER THE CONTEST: Eligible participants (each, an “Entrant”) can enter by submitting a completed online entry form available at http://info.edmentum.com/2017-SI-SummerUsageContest_Registration.html. Only one entry per school building will be accepted. Participation in the "Edmentum Summer Academic Sprints” ("Contest") constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and by the decisions of the Sponsor, which are final and binding in all respects. All submissions and supplemental resources must be original and must therefore contain no third party material. Entries must be submitted by August 18, 2017 at 11:59 PM CDT for participation.

TIME PERIOD: The contest will begin at 12:00 a.m. Central Daylight Time (CDT) on June 1, 2017, and end at 11:59 p.m. CDT on August 18, 2017. This constitutes the "Contest Period."

ELIGIBILITY: The Contest is open to all current Study Island school and district customers of Sponsor as of August 18, 2017 that operate Kindergarten – 12th Grade schools. A minimum of 15 students per school building must participate during the Contest Period to be eligible for school level prizes. Employees, officers and directors of Sponsor, or Sponsor’s affiliates, subsidiaries, agents or advertising and promotion agencies ("Released Parties"), as well as the immediate family members (parents, children, siblings, spouses) or persons living in the same household (whether related or not) of the Released Parties are not eligible to participate in the Contest. All federal, state and local laws and regulations apply. The contest is subject to all application laws and void where prohibited, taxed or restricted by law. 

WINNER SELECTION: Entries will be separated and judged according to the following three grade spans: Elementary School (Kindergarten – 5th Grade), Middle School (6th-8th Grade), and High School (9th-12th Grade). Within each of the three grade spans there will be one school prize winner and two student prize winners (1st and 2nd place). The winning schools will be selected based upon the total number of questions answered correctly in Study Island divided by the total number of students from the school that participated in this contest. The school from each grade span with the highest average number of questions answered correctly per student will be designated a winning school, as long as the school has an average percentage of questions correct per student of at least 60%. The students from each grade span that individually answer the most questions correctly in Study Island will be selected as a winning students, as long as their average percentage of questions answered correctly during the Contest Period is at least 60%. The top student wins first place, and the second student wins second place. Custom content and open-ended questions will be excluded. To the extent that more than one student answers the same number of questions correctly, the winning student will be determined by the highest percentage of questions answered correctly in Study Island during the contest period. In the event of a tie among schools based on the above criteria, the winning school will be chosen based on the percent of questions answered correctly in Study Island during the contest period.

PRIZES: The three winning schools (one designated from each grade span) will receive a $250 gift card to a retailer to purchase supplies for the school, and a $250 gift card to be used toward a pizza party. The three first place winning students (one designated from each grade span) will receive one chromebook and a $100 Amazon Gift Card. Additionally, the winning students’ schools will receive a $150 gift card for a pizza party, and $100 in Amazon gift cards for the student’s educator(s). The three second place winning students (one from each grade span) will receive a $100 Amazon gift card. Additionally, the winning students’ schools will receive a $150 gift card for a pizza party, and $100 in Amazon gift cards for the student’s educator(s). Distribution of the $100 Amazon gift card for the winning students’ educators will be at the school’s discretion. The prizes must be claimed by September 30, 2017, or prizes will be forfeited and no compensation will be awarded. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize with another prize of equal or greater value.

WINNER NOTIFICATION: Sponsor will attempt to contact all prize winners on or before August 31, 2017, by phone and/or email. For student winners, sponsor will contact their associated school by phone and/or email. Sponsor will make THREE (3) attempts to contact the potential winners at the telephone or cell phone number and/or email provided when entering the Contest. If a prize winner cannot be contacted within 3 days of the first attempted contact, or if a prize winner does not meet the eligibility requirements, that prize winner may be deemed ineligible and an alternate prize winner will be selected by the judge(s) based on the criteria described herein. In the event of a dispute regarding the identity of an individual who actually submitted a Contest entry, the entry will be deemed submitted by the authorized account holder of the email account. "Authorized account holder" is defined as the natural person who is assigned to an email account by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitting email address. Prizes are not exchangeable or transferable.

PUBLICITY:  By entering the Contest, each entrant grants Sponsor permission to use the person’s name, likeness, voice, photographs, video, opinions, statements, address and email address, for promotional purposes. Any use of the forgoing information may be in any manner or media now or hereafter known or existing, worldwide, in perpetuity and without compensation, notice or further consent, unless prohibited by law.  The information received from the entrants will be used or shared in accordance with Sponsor’s Privacy Policy (http://www.edmentum.com/privacy-policy). 

TERMS AND CONDITIONS: The Entrant is responsible for all costs associated with the compilation and submission of entries. All Contest entries must be received during the Contest Period specified above. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Entries must be submitted in English. By participating in this Contest, Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest.

LIMITATION OF LIABILITY RELEASE: By participating in this Contest, each entrant agrees that Sponsor and related organizations, their agents and employees (“Released Parties”) have no liability whatsoever for any injuries, losses, or damages of any kind which result from use of the Prize, or by participation in the Contest. No responsibility is assumed by Sponsor for (a) incorrect or inaccurate entry information or late, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries received through impermissible channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Contest including, without limitation, multiple entries by the same person through use of automatic registration or other similar programs; (e) typographical, electronic or human errors that may occur in the offer or administration of the Contest or the processing of entries; (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest, or from viewing, playing or downloading any material from Sponsor’s website; or (g) from the acceptance or use of the Prize.

Sponsor reserves the right, without prior notice and at any time, to terminate or suspend the Contest in whole or in part, to extend the End Date or to modify the Contest or these Official Rules in any way, in its sole discretion.  Sponsor reserves the right to void any entry if it believes such entry was submitted other than as required by these Official Rules or that the entry has been tampered with in any manner. 

Sponsor does not assume any responsibility for any schedule changes in the Contest timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Contest schedule.

INTERNET LIMITATIONS of LIABILITY: If for any reason, this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest, the Sponsor reserves the right, at its sole discretion, to terminate, modify or suspend the Contest in whole or in part, at any time, without notice and to select a winner, in Sponsor's sole discretion, from all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to Entrant's systems occasioned by participating in this Contest or by downloading any information necessary to participate in the Contest.

DISPUTES: By entering the Contest, Entrant agrees that (1) Any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the prize awarded, shall be resolved individually, without resort to any form of class action; and (2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, and Entrant shall not seek or be entitled to any punitive, consequential, exemplary or other damages, including costs associated with entering the Contest or attorneys' fees. Questions concerning the construction or interpretation of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Contest, shall be determined by the Sponsor in its sole and absolute discretion. 

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MINNESOTA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS CONTEST AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN MINNESOTA HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR CONTEST ENTITIES IN CONNECTION WITH THIS CONTEST AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
